These Terms of Service ("Terms") govern your use of the Bow Buddy website, online store, and related services, as well as purchases made directly from Bow Buddy.

Throughout these Terms, "Bow Buddy," "we," "us," and "our" refer to Bow Buddy LLC.

By accessing our website, purchasing a product, or otherwise using our services, you agree to these Terms. If you do not agree to these Terms, please do not use our website or purchase products through it.

1. Bow Buddy

Bow Buddy LLC sells vehicle-mounted equipment hangers, archery accessories, hunting accessories, replacement components, and related products.

2. Online Store Terms

You may use our website and purchase our products only for lawful purposes.

You may not use our website or products to violate any applicable federal, state, local, or international law or regulation.

You agree not to:

• Use our website for fraudulent purposes;

• Provide false payment, shipping, or account information;

• Attempt to interfere with the operation or security of our website;

• Copy, reproduce, scrape, or commercially exploit website content without authorization;

• Infringe Bow Buddy's intellectual property rights; or

• Purchase products for unlawful resale, counterfeiting, reverse engineering, or other unauthorized commercial purposes.

We reserve the right to refuse or cancel orders when reasonably necessary to prevent fraud, abuse, unauthorized resale, pricing errors, or other unlawful or improper activity.

3. Product Information

We make reasonable efforts to accurately describe and display our products, including their dimensions, colors, materials, compatibility, and intended uses.

However, minor variations may occur due to manufacturing processes, screen settings, material batches, production tolerances, or product improvements.

Product photographs and digital renderings are provided for illustrative purposes and may not perfectly represent the appearance of the product you receive.

We may modify or improve our products from time to time without notice, provided those modifications do not materially change an already-confirmed customer's order without appropriate notice.

4. Vehicle Compatibility

Bow Buddy products are designed to fit a wide variety of vehicles, but vehicle designs, headrest posts, seats, clearances, and configurations vary.

References to vehicle compatibility are intended as general guidance and do not constitute a guarantee that every Bow Buddy product will fit every trim level, seat configuration, model year, aftermarket seat, or vehicle modification.

Customers are responsible for reviewing product dimensions and compatibility information before purchasing.

If you are unsure which Bow Buddy product is appropriate for your vehicle, please contact us before ordering.

Eligible fitment-related returns are governed by our Return & Refund Policy.

5. Vehicle Safety and Product Use

Bow Buddy is an aftermarket vehicle accessory.

Any rigid object, accessory, or piece of equipment located within a vehicle passenger compartment may present a risk of injury during sudden stops, abrupt vehicle movement, or a collision.

Bow Buddy is an equipment hanger and organizer. It is not a crash-rated cargo restraint system.

Customers are responsible for installing and using Bow Buddy products safely and according to all provided warnings and instructions.

Do not install or use Bow Buddy in a location where it may:

• Interfere with airbags;

• Interfere with seat belts or child restraints;

• Prevent a headrest or seat from functioning as intended;

• Obstruct the driver's visibility;

• Interfere with vehicle controls;

• Create an unreasonable contact or impact hazard for a vehicle occupant; or

• Otherwise interfere with a vehicle safety system.

Bow Buddy recommends removing the product when it is not in use, particularly when an adjacent seating position will be occupied.

Customers should inspect their Bow Buddy before use and discontinue use if the product is cracked, materially damaged, excessively worn, improperly fitted, or otherwise appears unsafe.

Additional requirements and warnings are contained in our Vehicle Safety Notice, which is incorporated into these Terms.

6. Bows, Firearms, Hunting Equipment, and Other Gear

Bow Buddy products may be used with various types of equipment.

The customer is solely responsible for determining whether an item can be legally and safely transported, stored, or carried in a particular vehicle or jurisdiction.

Laws governing bows, firearms, hunting equipment, weapons, and vehicle transportation vary by jurisdiction.

Bow Buddy does not represent or warrant that using one of our products satisfies any particular federal, state, local, or other legal transportation, storage, or accessibility requirement.

Customers are responsible for understanding and complying with laws applicable to their equipment and location.

7. Orders

Submitting an order does not necessarily mean that we have accepted it.

We reserve the right to decline, limit, or cancel an order for legitimate reasons, including:

• Suspected fraud;

• Incorrect pricing;

• Inventory errors;

• Payment authorization problems;

• Shipping restrictions;

• Product availability;

• Unauthorized resale activity; or

• Other circumstances that reasonably prevent us from fulfilling the order.

If we cancel an order after payment has been collected, we will refund the applicable amount.

8. Pricing

Prices may change at any time without notice.

The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious pricing or technical errors.

We reserve the right to correct typographical, pricing, promotional, or technical errors.

If a material pricing error affects an order you have already placed, we may contact you and provide the option to proceed at the corrected price or cancel the affected order for a refund.

9. Promotions and Discount Codes

Promotional offers, discount codes, giveaways, bundles, and special offers may be subject to additional terms.

Unless otherwise stated:

• Discounts cannot be combined;

• Promotions have no cash value;

• Promotions may be limited to certain products or customers;

• Promotions may be modified or discontinued where legally permitted; and

• Promotional pricing does not apply retroactively to previously completed purchases.

We reserve the right to reject fraudulent, duplicated, manipulated, or unauthorized use of promotional offers.

10. Shipping and Delivery

Shipping estimates are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

Delays may occur due to carriers, weather, holidays, emergencies, address problems, high order volume, or circumstances outside Bow Buddy's reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

If a package is returned because an incorrect or incomplete address was supplied by the customer, additional shipping charges may apply before the order is resent.

Federal rules governing internet orders generally require sellers to have a reasonable basis for advertised shipping times and provide appropriate options when shipment cannot occur within the promised period. Bow Buddy intends to comply with applicable shipping requirements.

11. Lost, Stolen, or Misdelivered Packages

If tracking information indicates that an order was delivered but you cannot locate it, please contact the carrier and Bow Buddy as soon as possible.

We will reasonably assist with legitimate carrier claims and delivery investigations.

Bow Buddy is not responsible for theft occurring after a package has been properly delivered to the address provided by the customer, except where otherwise required by applicable law.

Cases involving incorrect items, shipping errors attributable to Bow Buddy, or packages damaged before delivery will be handled according to the circumstances of the order.

12. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms.

Unless otherwise stated, eligible standard products may be returned within the applicable return period subject to the requirements of that policy.

Custom, personalized, branded, bulk, or specially manufactured products may be subject to different return restrictions.

13. Lifetime Warranty

Certain genuine Bow Buddy products are covered by our Lifetime Warranty, subject to the terms, limitations, exclusions, and eligibility requirements stated in that warranty.

The Lifetime Warranty is separate from our 30-day return policy.

Warranty coverage generally applies to eligible product failures or manufacturing defects and does not necessarily cover:

• Intentional damage;

• Abuse or misuse;

• Unauthorized modification;

• Improper installation;

• Normal cosmetic wear;

• Loss or theft;

• Counterfeit products;

• Products manufactured by third parties pretending to be Bow Buddy; or

• Damage caused by use outside the product's intended purpose.

Our written warranty will be made available to customers before purchase where required by applicable law.

14. Counterfeit and Unauthorized Products

Bow Buddy products are sold through Bow Buddy's official website and certain authorized retailers, distributors, marketplaces, affiliates, and sales channels.

Unfortunately, counterfeit or imitation products may be offered by unauthorized sellers.

Bow Buddy cannot guarantee the quality, safety, authenticity, performance, or condition of counterfeit products or products falsely represented as genuine Bow Buddy merchandise.

Unless otherwise required by law, Bow Buddy does not provide refunds or replacement products for counterfeit merchandise purchased from unauthorized third parties.

Warranty claims may require proof of purchase sufficient to establish that the product is a genuine Bow Buddy product.

15. Third-Party Marketplace Purchases

Products purchased through Amazon, TikTok Shop, retailers, dealers, distributors, or other third-party platforms may also be governed by the policies and terms of the original seller or marketplace.

Returns and refunds may need to be processed through the original point of purchase.

Nothing in this section eliminates warranty rights that expressly apply to genuine Bow Buddy products.

16. Custom, Corporate, Wholesale, and Bulk Orders

Custom, branded, personalized, wholesale, corporate, promotional, and bulk purchases may be governed by separate quotes, purchase orders, invoices, specifications, proofs, or written agreements.

If there is a conflict between these Terms and a separately executed written agreement governing a custom or commercial transaction, the separately executed written agreement controls to the extent of that conflict.

Once custom manufacturing, printing, decoration, tooling, procurement, or production has begun, deposits and payments may become non-refundable as specified in the applicable quote or agreement.

Customers are responsible for reviewing and approving logos, artwork, colors, quantities, dimensions, proofs, and specifications before production.

17. Intellectual Property

The Bow Buddy name, Bow Buddy logo, product names, product designs, photographs, videos, graphics, packaging, website content, slogans, and other brand assets may be protected by trademark, copyright, trade dress, patent, or other intellectual property laws.

Bow Buddy® and associated Bow Buddy branding are proprietary to Bow Buddy.

Hang It! Don't Bang It!® and other registered or claimed marks may not be used without authorization.

Nothing contained on our website grants you ownership or a license to use Bow Buddy intellectual property except as expressly authorized in writing.

18. Reviews, Photos, Videos, and User-Submitted Content

If you voluntarily submit a review, testimonial, photograph, video, social-media post, or other content directly to Bow Buddy, you represent that you have the right to submit that content.

Where you expressly authorize Bow Buddy to repost, feature, or use submitted content, you grant Bow Buddy permission to use that content for the authorized purpose.

We will not knowingly represent an endorsement or testimonial in a materially misleading manner.

19. Website Availability

We attempt to keep our website and online store operational, but we do not guarantee uninterrupted availability.

The website may occasionally be unavailable because of maintenance, technical failures, platform outages, cybersecurity issues, or circumstances outside our control.

We may modify, suspend, or discontinue portions of the website when reasonably necessary.

20. Third-Party Services and Links

Our website may interact with or link to third-party services, including payment processors, social-media platforms, shipping carriers, marketplaces, and other websites.

Bow Buddy does not control every aspect of those third-party services and is not responsible for their independent acts, omissions, content, privacy practices, or terms.

Your use of a third-party service may also be governed by that company's terms and policies.

21. Disclaimer of Warranties

Except for warranties expressly provided by Bow Buddy and except where prohibited by applicable law, our website and services are provided on an "as available" basis.

Nothing in these Terms is intended to disclaim or limit any warranty or consumer right that cannot legally be disclaimed or limited.

Any warranty disclaimer contained in these Terms is subject to our written Lifetime Warranty and applicable federal and state law.

22. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Bow Buddy LLC and its owners, officers, employees, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of our website, services, or products where such damages may lawfully be excluded or limited.

Bow Buddy is not responsible for damages resulting from:

• Improper installation;

• Misuse or abuse;

• Unauthorized product modification;

• Failure to follow product instructions or warnings;

• Use of damaged products;

• Use that interferes with vehicle safety systems;

• Failure to comply with applicable laws; or

• Use of counterfeit or unauthorized products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from applicable product-safety or consumer-protection laws.

23. Indemnification

To the extent permitted by law, you agree to indemnify and hold Bow Buddy harmless from third-party claims arising from your unlawful misuse of our website or products, your violation of these Terms, or your infringement of another party's rights.

This provision does not require a consumer to indemnify Bow Buddy for Bow Buddy's own conduct where such an obligation would be prohibited by applicable law.

24. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except where federal law or mandatory consumer-protection law provides otherwise.

Any rights that consumers possess under mandatory laws applicable in their state or country remain unaffected where those rights cannot lawfully be waived.

25. Disputes

Before initiating formal legal proceedings concerning a transaction with Bow Buddy, we encourage customers to contact us at bowbuddystore@gmail.com and provide a reasonable opportunity for us to resolve the issue.

Nothing in this section prevents either party from pursuing remedies available under applicable law.

Unless Bow Buddy adopts a separate arbitration agreement or dispute-resolution provision, these Terms do not require mandatory arbitration.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will remain in effect.

27. Waiver

Bow Buddy's failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision in the future.

28. Entire Agreement

These Terms, together with policies incorporated by reference, constitute the agreement governing your use of our website and direct purchases from Bow Buddy, except where a separate written agreement applies.

29. Changes to These Terms
